Lawsuit filed to disqualify Senators from Impeachment Trial

On December 18, 2019 after 6 hours of debate, the House of Representatives voted to impeach President Donald Trump. Soon thereafter, attorney Todd Gallinger’s former work associate Martin F. McMahon, a Washington attorney, filed a personal lawsuit in U.S. Federal District Court charging four Trump enablers: Senators Cruz, Graham, McConnell, and Paul asking the Court to disqualify them as jurors in the upcoming impeachment trial.

Attorney McMahon is objecting to plans announced by Sens. McConnell, Cruz, Graham and Paul to short circuit the impeachment trial and quickly acquit the President. McMahon charges that, by announcing their verdict of acquittal before hearing any testimony, the four Senators violated their oaths of office which require they sit as impartial jurors in impeachment trials.

McMahon is asking the DC Federal Court to disqualify the Senators from serving as floor manager [McConnell] and jurors [Graham, Cruz and Paul] in the Trump impeachment trial.

McMahon asserts that the Senators have also violated his and all Americans’ constitutional right to determine, on their own, whether this president has violated the ideals of this great nation and betrayed his office for personal gain.

Contrary to Sen. McConnell’s assumption, attorney McMahon believes that the American people are fully capable of sifting through conflicting evidence and educating themselves about bribery, high crimes and misdemeanors, obstruction of justice, and a Nixonian type cover up.

The lawsuit demands that the Senate hold a genuine trial with live testimony, exhibits, witnesses and deposition transcripts, based upon his constitutional right under the Ninth Amendment–to observe a genuine and authentic impeachment trial. He is asking the Court to order that live witnesses be called to testify.

The result will be that all Americans, not just the Plaintiff, will reap the benefits of an authentic trial so they can evaluate the proof one way or the other regarding the President’s culpability.
Since this country is rife with divisiveness, McMahon believes that all citizens need to be informed about the President’s conduct and make up their own minds about whether he should be removed from office.
